Strickland’s Gun Case Similar to Portland Case That Just Ended In Not-Guilty Verdict

Exactly one week ago on Monday, a Multnomah County judge found a man not guilty of doing the same thing a Portland reporter is alleged to have done on the streets of downtown Portland.

Monday, Mike Strickland will have his day in court as he asks for reduced bail in the case against him. Strickland has been charged with two felonies and two misdemeanors related to unholstering his gun as Black Lives Matter protesters charged him last week. Strickland was in fear of great bodily injury or worse.

“Self Defense”: Lefty Videographer at BLM Protest Told Cops Twice That PDX Reporter Mike Strickland Drew Gun In Self Defense

At about 5:00 in the afternoon in October of 2015, Stevan Blagojevic was minding his own business on a walk in downtown Portland, when he happened upon an all-too-familiar scene.

Perched near the side walk was an apparently homeless man who decided for some reason that he would make Blagojevich the object of his copious amounts of scorn. Blagojevich’s attorney Jason Short told VictoriaTaft.com that the drifter decided he was going to teach Blagojevic a lesson and “kick his ass.”

The large man began charging Blagojevich — until Blagojevich unholstered his semi-automatic pistol and pointed it at him. The man stopped charging.

As Short told VictoriaTaft.com:

“My client was in fear of imminent serious physical injury and he did the right thing. This guy could have easily pummeled him, punched him, threw him on the ground. He could have killed him. So, he pulled out his gun, did what anybody would do, pointed it at him, and simply told the charging man, ‘Back the ‘f’off, get away from me!'”

As he drew down on his would-be attacker, he ordered another person to call 9-1-1 and waited for the cops.

Short says that when police arrived, Blagojevich showed them his drivers license and concealed weapons permit. He offered to show his gun to cops, who said, ‘no, just keep it in your pocket.’ Blagojevich was not cited and he went about living his life.

But months later, the Multnomah County DA decided to file a charge against Blaogojevich. He was charged with one count of menacing, which in Oregon is a Class A misdemeanor.

That case ended last Monday, when, in a bench trial, Judge Jerry Hodson found Blagojevich not guilty of menacing. Why? Because defending yourself against a charging, menacing person is not against the law. It’s actually reasonable. 

This is essentially the same type of scenario that Mike Strickland confronted.

The DA’s office has already shown prejudice against Strickland by increasing the charges (see previous posts). 

I have one question: Will the DA’s office admit it was wrong and drop the charges?

And Mike has a question of his own:

“What I want to know was if I can’t use my gun, what were my legal options for self defense?” 

Let’s hope Multnomah County’s justice answers that question swiftly and in Mike’s favor soon. After all, the precedent was just set one week ago. And Strickland’s  attorneys are Jason Short and Chris Trotter, who just successfully defended Blagojevich.

 

 

Oregon Medical Association top doc at Gabby Gifford event says f**k gun rights laws

Daylight Disinfectant was given extraordinary access to a recent anti gun confab with shooting victim turned anti gun activist former Congresswoman Gabby Gifford recently in Portland, Oregon.
Between comments suggesting gun grabbing laws be cloaked under the guise of public health standards like seatbelt laws, there were self satisfied smiles, and much anthropomorphizing of guns (when guns are dangerous…), it was quite a smug fest.

They claim to love victims, but seeks to create more through their efforts to curb access. Watch the video.

 

Zimmerman Trial: Left Calls Self Defense Laws “Kill at Will”

Making the rounds today is this graphic of where Stand Your Ground or self defense laws exist and where they refer Zimmerman kill at willto them as Kill at Will states.What’s the old saying? I’d rather be judged by 12 (in this case 6) than carried by six? These people won’t be happy until all victims refuse to fight back.

For those of you who didn’t bother to watch or read about the trial and its aftermath except to receive as gospel the Rev Al’s talking points about it, both the chief prosecutor and lead attorney for the state said definitively that self defense laws did NOT make it harder to try George Zimmerman AND that they haven’t changed much over the years. Zimmerman Trial Prosecutors: Stand Your Ground/Self Defense Did NOT Make it Harder to Prosecute Zimmerman

Prosecutors in the George Zimmerman case were asked by media members last night after the verdict if self Zimmerman DA2defense and Stand Your Ground laws made it more difficult to prosecute him. Both said no and both said in fact that the law in Florida hadn’t changed all that much at all since Stand Your Ground was passed in 2005. So much for that media meme. Still, I know it will come back time and again, so let’s get some quotes out there so even the folks who live on Hawthorne Blvd can understand them.

At 10:06, a reporter from the Miami Herald asks about the Stand Your Ground law.

Reporter: Can you talk about the Florida Stand Your Ground law and whether the changes in 2005 in the law affected the facts in this case and whether this case could have been won, perhaps, pre the changes in the law”

Prosecutor Angela Corey: “Well, justifiable use of deadly force has changed to a certain extent. Stand Your Ground is a procedural mechanism as we call it where we fully expected it because of what we were hearing that the defense would request a Stand Your Ground hearing, we would have put on the same evidence. It would have been front of just a judge instead of a jury. 

Reporter: What about the duty to retreat aspect?

Prosecutor Corey: Well the duty to retreat aspect had sort of disappeared before Stand Your Ground kicked in. 

And at 18:45 we have this question asked of  Prosecutor De La Rionda,

“Could I get your impression of the 2005 expansion of the Florida self defense statutes? Does this make your job harder?”

Prosecutor Bernie De La Rionda, “You know self defense has existed for a long time. And we’ve dealt with it in Jackson for a long time. We’ve tried a lot of self defense cases; I’ve personally tried ten-15 self defense cases. They’re tough cases, but we accept it so… The law really  hasn’t changed all that much. Stand Your Ground was a big thing, but really the law hasn’t changed. We have a right to bear arms and a right to self defense.”

Oregon City Police: Woman’s Gun Saved Her From Attack

Note to Colorado lawmakers: My guess is that a rape whistle would not have saved her. Looks like this 22 year old victim chose the “Conservative Rape Tip” to save herself.

OREGON CITY WOMAN DEFENDS OFF A STRANGER ATTACK WITH HER HANDGUN.

The Oregon City Police Department is investigating an Assault and Kidnapping case which occurred Sunday night, March 31st at about 10:21 pm.  A 22 year old woman had just parked her car near the intersection of 8th St and JQ Adams St in Oregon City when she was attacked by an unknown male assailant.  The stranger approached her from behind grabbing her pony tail dragging her backwards.  He continued to assault her until she was able to defend herself by producing her legally owned handgun.  The victim pointed her handgun at the male assailant and he fled on foot.

Several Oregon City Police assisted by a Gladstone K-9 Officer responded to the scene.  Police officers and a police K-9 searched for the suspect, but were unable to locate him in the area.  Oregon City Police are currently investigating these crimes.

The suspect is described as a white male in his late 20’s approximately 5’8″ tall with a slender build.  He had medium length hair down to his chin and no facial hair.  He was last seen wearing a brown zip up style jacket or hoodie with dark colored pants.

The Oregon City Police Department is requesting help from anyone who may have witnessed the suspect or this attack.
