Facebook ‘fans’ of State Senator Ginny Burdick were surprised to learn that the Oregon State legislator held a Town Hall meeting March 27th. Apparently it was an invitation only affair, because the only invitation I could find appeared only less than 24 hours before the event on the facebook page of the actual  venue, the Mirabella Retirement Community (see screen cap below).

You may recall that the gun hating Senator cancelled her March 4th Town Hall at Portland State University claiming a ‘scheduling conflict’ but in fact stayed home. Burdick’s ‘scheduling conflict’ consisted of bringing home her take out dinner and then taking in her garbage can as recorded by a citizen journalist. 

She then began a campaign strategy known as “throw every excuse against the wall and see what sticks,” claiming she was “threatened” “by the gun lobby” (constituents who own fire arms) and that’s why she didn’t attend the meeting.  She eventually landed upon cancelling it for the children because she couldn’t have such riff raff on a college campus. As if that wasn’t guffaw inducing enough, she then doubled down on her sorry excuses by going on the Al Sharpton show to complain about the hectoring (cranky emails and  facebook posts) by “gun extremists” (people who believe in the Second Amendment of the US Constitution) in the “gun lobby.” Well, at least she went to the right place, Sharpton’s an expert on hectoring people. And lying. He’s good at that too.

When I made a public records request for her to produce the documented threats she lateralled  my request to the legislative counsel’s office which claimed she didn’t have to produce documents while the legislature is in session. She could produce the documents if she wanted to, she just doesn’t want to. Of course, to produce documented threats she would have to possess proof. Draw your own conclusion. 

Among Burdick’s anti gun legislation this legislature: limiting Oregon citizens to ONE gun, allowing cops to search your home every year to make sure you are properly storing your weapons, reducing magazine sizes, outlawing most hand guns, banning guns on school campuses and other assorted anti gun laws.

So it appears that now the so called public servant only wants to serve the public who agrees with her and is now selecting her audiences and announcing the events afterward. You have to be on her email list to find out there even was a town hall or check out her spottily updated facebook page after the fact (see screen cap).  A google search on the town hall turned up one advance mention: at the venue’s facebook page. Gee, why didn’t we think to look there before? Oh, wait…

No one in official Oregon has condemned her political cowardice for cancelling the first town hall or her lies following it. Many of her Democrat contemporaries loved the joke on the “wacko” “gun extremists,” by “liking” her town hall post. In fact, the left has so far applauded her for standing up to the gun ‘nuts’ with the “Rambo complex.’ Lying to constituents to avoid them is OK in Oregon now. Duly noted. We’ll make sure everyone remembers at election time.

Ginny Burdick Takes Cover Behind Her Office in Gun Battle

Public Records Ginny BurdickState Senator Ginny Burdick, who claimed she cancelled a March 4th citizen’s town hall meeting because of threats against her by “gun extremists,” is now stonewalling efforts to see proof of those threats. Burdick has alleged threats against her on local and national television.

As I reported here, on March 8th, I filed a public records request with Senator Burdick’s office to receive,

“…all reports by the Senator and her staff to law enforcement and recordings, written communications, including texts, facebook messages, emails and tweets, and visual proof of threats she received prompting her to cancel her Town Hall meeting at Portland State University on March 4, 2013.”

I concluded my request by stating,

Ms. Burdick has made very serious allegations against people she has described recently in interviews and on her own facebook page as gun nuts and wackos. It’s necessary for her to substantiate her claims of threats and I look forward to reporting on the veracity of those claims.

As I reported here, Burdick provided KATU news with emails she claimed were threatening but which did not appear to rise to the level of actual threats. Were they threats there would have been more prominent news coverage and criminal charges forthcoming. Here’s an example she gave to the TV station.
But instead of satisfying the request for documents to prove these new allegations, something that should have been easy for her staff to do, she lateraled my request to the Legislative Counsel Dexter A. Johnson who sent me this response which read in part,
The Legislative Assembly and members and staff of the Legislative Assembly are not subject to the public records law during periods in which the Legislative Assembly is in session.  ORS 192.410 (5).  The Legislative Assembly is currently in session and therefore will not be providing the materials you requested.
In short, Burdick isn’t required to honor requests for documents until the session is over. I asked attorney and VictoriaTaft.com Blog member Bruce McCain who confirmed Burdick can’t be compelled to turn over documents until the legislature is over and added, 

But even if Burdick defamed an individual (a class of unidentified persons doesn’t qualify) she could not be served with civil process while the legislature is in session. But merely describing her political opponents as crazy, nuts, or whackos doesn’t rise to actionable defamation of an individual.

And if Burdick accuses someone of “threatening” her which is a criminal offense? Should she have to prove her allegation? McCain continues,

As far as records of a member of the Legislative Assembly that may relate to criminal activity, that is an entirely different issue. Public records law wouldn’t even apply because law enforcement (not the general public) could get to those records through warrants and subpoenas. But that still doesn’t mean a member of the general public is entitled to see exempt public records just because the records may be related to criminal activity.  

If she chose to, Burdick could turn over any documents to prove her allegations of ‘threats’ against her but has not. Why not?

Here are some possibilities: 

  1. She’s planning to wait till after the session is over.
  2. She can play victim  (as she did recently on MSNBC) and cast her political opponents as criminals. 
  3. The State Police are investigating.
  4. She has no proof.

If there’s no crime, then Ginny Burdick is both a liar and a coward. One who uses the imprimatur of authority to politically marginalize constituents who have an honest difference of opinion with the State Senator on civil rights. And a coward who hides behind her office now just as she hid from her constituents on March 4th. 


Ginny Gitcherguns Burdick Heavy Lifting for Anti Gun Groups, Not So Much for Constituents

Poor State Senator Ginny Burdick. She’s been so busy at the legislature acting as bell boy for anti gun groups like Cease Fire Oregon –very heavy lifting–that she over-scheduled herself and couldn’t show up to her own Town Hall meeting last night at Portland State University.  As you know by reading my post last Wednesday (here)  Burdick cancelled the meeting “due to scheduling conflicts.” Busy, busy, busy.

Ginny Gitcherguns Burdick had many, many important things to do so she couldn’t face her constituents last night. Constituents who are just a tad ticked off that Burdick’s latest gun grabbing effort after “assault weapons” bans and “clip” limits, includes limits on how many weapons you can own, one; forcible gun confiscations and warrantless searches and seizures. Give the busy gal credit, it takes an awful lot of time to violate that many constitutional rights in one bill. See my tally here.

So, what was Ginny doing last night? More heavy lifting it turns out. Her take out, her garbage pail, her recycling bin, her mail–everything but meeting with her constituents.
