Illegal Aliens Get a Free Pass from Obama by Rees Lloyd

President Barack Hussein Obama is evidencing his profound contempt for the American people and the rule of law by refusing to enforce the Military Selective Service Act (50 U.S.C. Section 451, et seq) against illegal aliens, while simultaneously enforcing a policy of de facto amnesty by dismissing deportation proceedings against thousands of illegal aliens who are in violation of that law as well as immigration laws, and while suing the people of Arizona for acting to protect their citizens against predatory illegal aliens. 
 
Illegal aliens are expressly required to register for the draft. The Selective Service Administration’s website notifies all persons, equally, that: “Almost all male U.S. citizens, and male aliens living in the U.S., who are 18 through 25, are required to register with Selective Service. … Some non-citizens are required to register … including illegal aliens, legal permanent residents, and refugees. The general rule is that if a male noncitizen takes up residency in the U.S. before his 26th birthday, he must register with Selective Service.” (Italics added.)
The penalties are substantial: “A man who fails to register may, if prosecuted and convicted, face a fine of up to $250,000 and/or a prison term of up to five years. Even if not tried, a man who fails to register with Selective Service before turning age 26 may find that some doors are permanently closed.”
Importantly, if an alien has not registered by “his 26th birthday,” it is too late.
Benefits which may be permanently foreclosed include: “Federal student loans or grant programs. This includes Pell Grants, College Work Study, guaranteed Student/Plus Loans, and National Direct Student loans[;] federal job training programs; and federal jobs in the Executive Branch of the Federal government and the U.S. Postal Service.” All men “born after Dec. 31, 1959,” must provide “proof of registration.”
As for illegal aliens and other non-citizens, including permanent residents legally residing in the U.S.: “The U.S. Citizenship and Immigration Services (CIS) makes registration with Selective Service a condition for U.S. citizenship if the man first arrived in the U.S. before his 26th birthday.” (Italics added.) 
 
However, as far as is known, not a single illegal alien who has broken the Selective Service law has been prosecuted, deported, or been denied a single benefit – including the priceless benefit of becoming an American citizen. The question of Selective Service registration is not even asked in deportation proceedings, or in applications for naturalization or adjustment of status, or on applications for federal or state benefits, including welfare, health care, Medicaid, education, job training, employment, etc.
Obama, commander in chief of the Armed Forces, even has a kind of “don’t ask, don’t tell” policy for illegal aliens: The Selective Service Administration home page blares in bold face type: “Attention, Undocumented Males & Immigrant Servicing Groups! Selective Service does not collect information which would indicate whether or not you are undocumented.”
It is reprehensible that while Americans in military service, the great majority between the ages of 18-26, are risking their lives defending America in the war against terrorism, many if not most male illegal aliens have failed – with impunity and de facto immunity – to fulfill their legal duty to register for Selective Service between the ages of 18-26.
Instead of meeting that duty, and acting to defend America, they, and “immigrant servicing groups,” including lawyers cashing in on the lucrative “immigration law” industry, arrogantly demonstrate against America in the streets, carrying the Mexican flag, raising their fists and demanding instant “amnesty” – free to do so because of Americans serving in the American military.
The American Legion, the largest wartime veterans organization in the world, with some 2.5 million members in more than 14,000 Posts, adopted as its national policy by vote of the National Convention in 2008 a resolution I wrote calling for equal application and enforcement of the Selective Service law to illegal aliens.
Instead, the Obama regime is now granting de facto amnesty to illegal aliens by dismissing pending deportation proceedings without requiring proof that those illegal aliens have registered for Selective Service, a criminal act, or even asking that question.
If there is to be a rule of law, it must be enforced against illegal aliens, too. No deportation proceeding should be dismissed, nor should citizenship be granted, pertaining to an alien who has failed in the elemental duty to register with Selective Service so as to be available to serve in military defense of America if called.
The rule should be clear, and enforced: If you won’t defend America, you don’t deserve to be in America. It is time to go.
