"NOT GUILTY ON ALL COUNTS" in the "largest immigration fraud case in Oregon history"

Now we've seen it all. Two people have gone to prison; one (the accused's daughter) has pleaded no contest, all in a continuing criminal enterprise to provide fake ID's so that the 80,000 illegal aliens could go to Miguel Robleto's Drive Master Education school and ultimately get Oregon Driver's Licenses.
While I haven't seen the entire 7 page decision yet, Judge Steven Price says yeah, there was smoke, but the DA's and AG's office didn't show me the fire. As a result Miguel Robleto goes free.

Testimony showed Mr. Robleto called to get more phony ID's for his "customers," illegal aliens who had been bused in from all over the country, but the judge didn't find that testimony persuasive enough. The point is if there's no Mr. Robleto, there's no need for phony ID's. I'm no judge, but even I can't overlook that. But the judge ruled he couldn't connect Mr. Robleto to the envelopes. The judge also said that Mr. Patel, who runs "The Dunes" motel in Hillsboro probably had illegal aliens bursting from the seams in every room, that's why he couldn't believe there was any unusual connection to Mr. Robleto's alleged fraudulent scheme to provide these non Oregon (heck, non US) citizens with driver's licenses. It doesn't matter that these illegals came by the bus load and went home in a day or two. Doesn't matter.

The judge refused to divulge his reasoning for the ruling in open court.

The most bizarre decision he made was to find Mr. Robleto not guilty on the misdemeanor charges of tampering/destroying public documents. The documents were destroyed.

If only this judge were in charge of the Scooter Libby prosecution. Can you imagine? Judge Price's rationale seems to be that it's no big deal the documents were destroyed because, hey, there's no crime!

The judge allowed as there were plenty indications of guilt but not beyond a reasonable doubt.

A question: now that the man who was alleged to be the ringmaster of this alleged crime has been found not guilty, then should the others be released? After all if you don't have the big guy, then the other guys were simply freelancing on a lark.
No crime, no foul, right?

12 REASONS WHY WE CAN'T AFFORD BASEBALL IN OREGON

I’d love baseball to come to Portland and I quiver at the prospect of the disgruntled Florida Marlins coming to P-Town, but I’ve come around to the belief that the city/county/state shouldn’t fund the majority of the cost. In fact a token contribution in the way of helpful permitting or helping with road construction to facilitate cars and trucks get to the ball park are fine with me. But I don’t want to use public monies to build a stadium so "they will come."

I want some owner to work a deal and buy his/her/their own doggone stadium.

We don’t have the money to spend on the stuff I want because we’re so busy spending money elsewhere.

Herewith are my 12 reasons why Portland, Oregon can't afford baseball:

We don’t have $ for baseball because that $15 million dollar tram turned into a $40 million dollar tram.

We don’t have $ for baseball because we’re spending it on…The campaigns of the Portland City Commissioners who thought they’d impose this cost on taxpayers without a vote of the people.

We don’t have $ for baseball because we’re spending it on…helping the Portland Public Schools build a new school at the Columbia housing projects…even though private parties wanted to put a charter school there. For Free.

We don’t have $ for baseball because instead of $10,000 in property taxes that would have been paid toward schools, fire, police, and running the government, the buyer of that $700,000 downtown condo only has to pay $198 bucks.

We don’t have $ for baseball because we’re spending it on…Portland’s civic EGO in the form of the inefficient, 19th century, Lightrail system, that moves less than 1% of commuters…for $100 million dollars a mile.

We don’t have $ for baseball because we’re spending it on…chasing businesses out of the city with the business income tax.

We don’t have $ for baseball because we’re spending it on… the Wapato Jail. Oh, wait, we don’t have the money to open the Wapato Jail. Nevermind.

We don’t have $ for baseball because we’re giving WIC, food stamps, free education, free health care, driver’s licenses, and free housing to people who broke the law and came to this country illegally.

We don’t have $ for baseball because we’re spending it on…a green roof for the Portland building and the multnomah county building.


We don’t have $ baseball because we keep paying for the mistakes of people who hired Steve Goldschmidt…and fired the janitors…offended panhandlers and pepper sprayed wimpy protesters.


We don’t have $ for baseball because the big dog in town…the Blazers…don’t want the competition for your sports dollar.


And finally we don’t have $ for baseball because we’re still spending it on… the renovation of PGE Park the last time we sniffed pine tar in the air.

No Verdict Today in the "largest immigration fraud case in Oregon history"

This is the second postponement of the verdict by the judge. Today he said in open court that he had failed to consider something so he would go back at it and announce the verdict on November 29th. What's going on here?

A small district in Washington State has voted to decertify their union. This is the organization they looked to for help: Northwest Professional Educators.
When union thugs follow the superintendent to the beach; when union thugs intimidate the school board members driving to work by mobbing their car and hitting it with signs and fists, you're left with the question: Are these the people you want representing you as a professional?
I can guarantee you the parents in that district are asking themselves this question: Do I want that thug in the classroom with my 6 year old?

Running Scared: Congressional Republicans

The Wall Street Journal takes to task the liberal republicans who have torpedoed the republican agenda in the latest budget. Who needs the Harry Reids and Nancy Pelosis when we've got these turn coats?

  • So, let's see: These Congressional giants are demanding that Americans be taxed more to pay subsidies to defray the soaring heating bills caused in part by Congress's refusal to allow more drilling for domestic oil and gas. In another bitter irony, the House has already voted for Alaskan drilling five times since 2001, only to be stymied by the Senate. Now that the Senate has maneuvered to pass ANWR with 51 votes by using the budget process to elude a filibuster, the House 25 are doing Harry Reid's dirty work.

  • America can survive these policy setbacks; the question is whether the Republican majority will, or even should. If a GOP Congress can't vote to sustain its own wildly successful tax cuts, or to explore for more domestic energy, let's just turn Congress over to Democratic Leader Nancy Pelosi and at least have truth in liberal advertising.

Poll: Most Americans Doubt Bush's Honesty

Most Americans say they aren't impressed by the ethics and honesty of the Bush administration, already under scrutiny for its justifications for an unpopular war in Iraq and its role in the leak of a covert CIA officer's identity.

Almost six in 10 _ 57 percent _ said they do not think the Bush administration has high ethical standards and the same portion says President Bush is not honest, an AP-Ipsos poll found. Just over four in 10 say the administration has high ethical standards and that Bush is honest. Whites, Southerners and white evangelicals were most likely to believe Bush is honest.

Bush, who promised in the 2000 campaign to uphold "honor and integrity" in the White House, last week ordered White House workers, from presidential advisers to low-ranking aides, to attend ethics classes.


The president gets credit from a majority for being strong and decisive, but he's also seen by an overwhelming number of people as "stubborn," a perception reinforced by his refusal to yield on issues like the Iraq war, tax cuts and support for staffers under intense pressure.
More than eight in 10, 82 percent, described Bush as "stubborn," with almost that many Republicans agreeing to that description.

Judge Mary James declared the voter approved Measure 37 unconstitutional thus halting Oregon citizens from their property rights that they have had to fight for years to regain.
The petition was filed by businessman Tom Steffen, of Silverton, October 26, 2005. The 14,402 signatures need to be collected by January 24, 2006 and then a special election for Marion County residents will be held.
Scapoose, OR resident Bob Ekstrom said, "A disengaged citizenry is the main reason government does not serve the people. Please get involved in this recall of a corrupt judge. Make a difference."
All Marion County residents who voted for Measure 37 in the 2004 election are requested to attend the Open House to sign a petition to 'fire' Judge James.
All other Oregon state residents are encouraged to come to Marion County to collect signatures this Saturday. Even teenagers can help collect signatures. Petitions are ready to go and lists of street addresses are available so you know you will be going to a house with registered voters. You will get the official petition, instructions on making sure voters print their name very clearly and that they do not write down a Post Office Box address or the name will not be counted. AMWASHINGTON (AP) - The increase in the number of people without health insurance has occurred largely because of illegal immigration, a study found.
Researchers at the RAND Corporation, a nonpartisan think tank, analyzed data received from about 2,400 people in Los Angeles County in 2000 and 2001, and applied that information to the nation's undocumented population at large.
The number of uninsured adults in the United States grew by about 8.7 million between 1980 and 2000. If the trend for Los Angeles County held true for the rest of the country, about a third of that growth can be attributable to illegal immigrants.
The study does not diminish the severity of the problem of the uninsured. Nor does it call for some sort of health insurance coverage for illegals.
"That's where I don't go," said James Smith, a senior economist at RAND. "That's not a scientific question."
Rather, the study shows that any meaningful impact on reducing the number of uninsured has to take into account the issue of illegal immigration, he said.
"There are pros and cons of providing insurance to the undocumented that should be debated openly," he said. "Undocumented immigrants make up too much of the issue to be ignored or hidden by polite silence."
The study also indicates that, since the number of illegal immigrants is growing rapidly, "we can expect that the uninsured population is going to grow rapidly as well," said another study co-author, Neeraj Sood.
The researchers said about one in five illegal immigrant adults have some health insurance coverage through their work, but virtually none of them purchase it on their own. Also, they rarely make use of public insurance through programs such as Medicaid.
The study was published in the journal Health Affairs.

You may recall the phone call we exchanged this past Tuesday afternoon.

I'm compelled to express concern about the lack of serious media coverage of the trial involving the alleged "kingpin" in what
The Oregonian termed, the largest racketeering and fraud case in Oregon history.

To bring you up to date, the trial ended late Tuesday afternoon with summations by both the prosecution and defense counsels.
Judge Price told all concerned that there was a 60% chance he'd issue a verdict next Tuesday, November 8th, at 8:30 am.

Before I proceed in listing the reasons for concern, I'd like to direct you to a September 3rd, 2005 article in the Itemizer Observer by Erin Zysett. It covers Lorna Youngs (the current head of State DMV & Transportation) firing of LaVay Jeffries, a Linn County DMV official, for notifying law enforcement when he suspected illegal activity.

Here are the most prominent reasons for concern:

1. Why was a trial about a "criminal enterprise" that literally flourished, in a POST/911 era, under state officials' noses NOT CONDUCTED in FEDERAL COURT?

Indeed, who made this decision which has all the earmarks of a cover-up? A number of us, including an outraged airline pilot, Chuck Weise, asked the prosecutor this question, who also seemed puzzled by the "downtown" decision by an undisclosed party.

2. Without ANY reflection against The Oregonian's Holly Dank's reporting, WHY did the Oregonian limit coverage to a suburban Portland Metro section?

3. Why hasn't the Oregonian asked similar questions that were repeatedly raised in the recent coverage about the sale of stolen items in second hand shops? Just to list a few:

a) Why confine pilot Privatized DMV agencies to Hispanics? And why contract the management of one those agencies to a former DMV employee that, according to trial testimony, had been terminated "under a cloud"?

b) Why haven't the above questions been directed towards the former head of Transportation, Bruce Warner, (who recently became the appointed head of the Portland Development Commission, PDC), and Lorna Youngs the current head of ODOT and the former chief of DMV?

c) According to testimony by an undercover Hillsboro detective, falsified Voter I.D. cards were among the credentials both recommended and facilitated both at Robleto's Drive Mater Education (DME) office in Hillsboro, and at "Carousels" staged by foreign counsuls, and attended by Oregon Elections and other state agency officials.

WHY haven't Governor Kulongoski and Secretary of State Bradbury been asked for some "EXPLANATIONS"?

d) In his trial summation, the Prosecutor made a critical rebuttal remark. He said that even though glitches in state law make it equally possible for anyone to access fake credentials, Mr. Robleto is no less guilty for at the very least, "aiding and abetting" the "criminal enterprise" that exploited the vulnerabilities of the present system.

So why is NO URGENCY being expressed by The Oregonian for lawmakers and State Agency officials to impose the safeguards sought by both the Federal Real I.D. Act and the Help America Vote Act, each of which require proof of legal status and identity for access to a drivers license AND for inclusion in the federally funded State Centralized Voter Registration process?

The Oregonian's very poor showing at trial has resulted in only two published Metro reports. This gives perhaps the indication of The Oregonian's desire to minimize the largest racketeering and fraud case in Oregon history and to conceal it from statewide readership.

To be quite blunt: This case at trial not only has Oregon statewide implications but more importanly, Nationwide implications.
The Oregonian's lack of coverage is outrageous.

#1 6/04- The Senate Intelligence Committee released bi partisan 500 page report about pre war intelligence. In addition to being angered at Joe Wilson for lying to the committee, the committee also finds there was never an attempt to, “coerce, influence, or pressure analysts to change their judgements related to Iraq’s weapons of mass destruction.”

#2 7/04-Butler report is issued by the British similarly finding there was no evidence of “deliberate distortion” although it criticised the quality of pre war intelligence.

#3 3/05—Robb-Silberman report on WMD intelligence was equally categorical, finding ‘no evidence of political pressure to influence the Intelligence Comunnuntiy’s pre war assessments of Iraq’s weapons programs…analysts universally asserted that in no instance did political pressure cause them to skew or alter anyu of their analytical judgements. We conclude that it was a paucity of intelligence and poor analytical tradecraft, rather than political pressure, that produced the inaccurate pre war intelligence assessments. **(Victoria here: guess that helps to answer the question about why CIA suits don't dig Bush)

#4 Patrick Fitzgerald—Prosecutor in the Scooter Libby case who said, “This indictment’s not about the propriety of the war, and [people who believe fervently in the war effort, people who oppose it, people who are—have mixed feelings about it should not look to this indictment for any resolution of how they feel or any vidication of how they feel."

7/03 Joe Wilson publishes his op ed piece in the NYT where he claims he’d debunked President Bush’s 16 words on the Iraqi attempt to buy yellowcake. He dropped his line after the Senate and Bulter reports(and even got dropped from the Kerry campaign when it was shown he had lied to the senate intelligence committee of which Kerry and John Edwards were members at the time) and has now resurrected them for the willing fans in the Bush Lied fan club.

*of note is Mr. Wilson’s debrief to the CIA in which he admitted Saddam had tried to buy yellowcake in 1999 when Saddam sent his people to Niger to make the overture, but didn’t make his op ed piece. The fact that Saddam did try to buy yellow cake before did, however, make the senate report and the butler report.

*The senate intelligence committee found it was Valerie Wilson who suggested her non WMD, didn’t write a report, was allowed to file a story telling about his mission in the NYT, who sent her husband. CIA docs also prove this conclusion.

Summary

The famous “16 words” in President Bush’s Jan. 28, 2003 State of the Union address turn out to have a basis in fact after all, according to two recently released investigations in the US and Britain.
Bush said then, “The British Government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa .” Some of his critics called that a lie, but the new evidence shows Bush had reason to say what he did.
A British intelligence review released July 14 calls Bush’s 16 words “well founded.”
A separate report by the US Senate Intelligence Committee said July 7 that the US also had similar information from “a number of intelligence reports,” a fact that was classified at the time Bush spoke.
Ironically, former Ambassador Joseph Wilson, who later called Bush’s 16 words a “lie”, supplied information that the Central Intelligence Agency took as confirmation that Iraq may indeed have been seeking uranium from Niger .
Both the US and British investigations make clear that some forged Italian documents, exposed as fakes soon after Bush spoke, were not the basis for the British intelligence Bush cited, or the CIA's conclusion that Iraq was trying to get uranium.
None of the new information suggests Iraq ever nailed down a deal to buy uranium, and the Senate report makes clear that US intelligence analysts have come to doubt whether Iraq was even trying to buy the stuff. In fact, both the White House and the CIA long ago conceded that the 16 words shouldn’t have been part of Bush’s speech.
But what he said – that Iraq sought uranium – is just what both British and US intelligence were telling him at the time. So Bush may indeed have been misinformed, but that's not the same as lying.
Analysis

The "16 words" in Bush's State of the Union Address on Jan. 28, 2003 have been offered as evidence that the President led the US into war using false information intentionally. The new reports show Bush accurately stated what British intelligence was saying, and that CIA analysts believed the same thing.

During the State the Union Address on January 28, 2003, President Bush said:
Bush: The British Government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa.

The Butler Report
After nearly a six-month investigation, a special panel reported to the British Parliament July 14 that British intelligence had indeed concluded back in 2002 that Saddam Hussein was seeking to buy uranium. The review panel was headed by Lord Butler of Brockwell, who had been a cabinet secretary under five different Prime Ministers and who is currently master of University College, Oxford.
The Butler report said British intelligence had "credible" information -- from several sources -- that a 1999 visit by Iraqi officials to Niger was for the purpose of buying uranium:
Butler Report: It is accepted by all parties that Iraqi officials visited Niger in 1999. The British Government had intelligence from several different sources indicating that this visit was for the purpose of acquiring uranium. Since uranium constitutes almost three-quarters of Niger’s exports, the intelligence was credible.
The Butler Report affirmed what the British government had said about the Niger uranium story back in 2003, and specifically endorsed what Bush said as well.
Butler Report: By extension, we conclude also that the statement in President Bush’s State of the Union Address of 28 January 2003 that “The British Government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa” was well-founded.
The Senate Intelligence Committee Report
The U.S. Senate Select Committee on Intelligence reported July 7, 2004 that the CIA had received reports from a foreign government (not named, but probably Britain) that Iraq had actually concluded a deal with Niger to supply 500 tons a year of partially processed uranium ore, or "yellowcake." That is potentially enough to produce 50 nuclear warheads.

That is a reference to Joseph Wilson -- who later became a vocal critic of the President's 16 words. Wilson reported that he had met with Niger's former Prime Minister Ibrahim Mayaki, who said that in June 1999 he was asked to meet with a delegation from Iraq to discuss "expanding commercial relations" between the two countries.Based on what Wilson told them, CIA analysts wrote an intelligence report saying former Prime Minister Mayki "interpreted 'expanding commercial relations' to mean that the (Iraqi) delegation wanted to discuss uranium yellowcake sales." In fact, the Intelligence Committee report said that "for most analysts" Wilson's trip to Niger "lent more credibility to the original Central Intelligence Agency (CIA) reports on the uranium deal."
The subject of uranium sales never actually came up in the meeting, according to what Wilson later told the Senate Intelligence Committee staff. He quoted Mayaki as saying that when he met with the Iraqis he was wary of discussing any trade issues at all because Iraq remained under United Nations sanctions. According to Wilson, Mayaki steered the conversation away from any discussion of trade.
For that reason, Wilson himself has publicly dismissed the significance of the 1999 meeting. He said on NBC’s Meet the Press May 2, 2004:
Wilson: …At that meeting, uranium was not discussed. It would be a tragedy to think that we went to war over a conversation in which uranium was not discussed because the Niger official was sufficiently sophisticated to think that perhaps he might have wanted to discuss uranium at some later date.
But that's not the way the CIA saw it at the time. In the CIA's view, Wilson's report bolstered suspicions that Iraq was indeed seeking uranium in Africa. The Senate report cited an intelligence officer who reviewed Wilson’s report upon his return from Niger:
Committee Report: He (the intelligence officer) said he judged that the most important fact in the report was that the Nigerian officials admitted that the Iraqi delegation had traveled there in 1999, and that the Nigerian Prime Minister believed the Iraqis were interested in purchasing uranium, because this provided some confirmation of foreign government service reporting.

M 37 "poorly worded" "political jumble" The Judge Shouldn't be Recalled--so says a Victoria Taft Show Blog emailer. What do YOU say?

Dear Listeners: Poorly worded? Has this writer read the judge's decision?

Victoria- This is mind-boggling. Judges should not have to worry about the realm of public opinion. Their job is to interpret the constitution to the best of their ablility. Measure 37 is poorly worded, and when it was put on the ballot, the rhetoric made it seem as though an efficient economic benefit for property is fair for those whose property is displaced by Measure 37. Worded properly, Measure 37 is a political jumble of inefficiencies created to benefit corporations in the State of Oregon. If you don't like the ruling of a judge, elect political officials, whose job it is to pay attention to public opinion, to amend ballot measures to the liking of the public, so that they will not be deemed unconstitutional by an "activist judge." The moment a judge is concerned more with public opinion than with interpreting the the constitution, then the judicial system begins to fail. What saddens me the most is that people like yourself (Taft) are unwilling to admit that we have a system set up to deal with situations like this - it's called the appelate courts. If Judge James's ruling is wrong, then it will be overturned. She wouldn't be the first judge in history to have a ruling overturned. I'm pretty sure Supreme Court Nominee Alito had a ruling overturned - by the Supreme Court. You don't seem to have a problem with that!

Largest Immigration Fraud Case in History of Oregon Wraps Up. Oregonian story? Nowhere.

The final statements were uttered by both sides Tuesday in the case of a Washington county man who is alleged to have perpetrated what the Oregonian newspaper calls the largest immigration fraud case in Oregon history. While there was an Oregonian reporter in the courtroom yesterday no story appeared today.

The Victoria Taft Show courtroom mole reports no fireworks occured in the courtroom. Rebuttal witnesses were called. One of the most curious witnesses was an Hispanic man who works for Teufel Nursery who, through the aid of a courtroom translator, said he was one of Mr. Robleto's customers.
I guess what we're supposed to draw from the testimony is that Mr. Robleto didn't only clear the way for 80,000 illegal aliens to get phony ID and therefore licenses but that he also helped out hard working, law abiding citizens too. Problem is no one, not the prosecution, not the defense (whose witness it was) ever, EVER asked the man if he was in the United States legally. I guess nobody cares.

In his closing statement defense attorney Fred Natchigal claimed the prosecution hadn't proven its case because there was no smoking gun. There was no one who saw Mr. Robleto, the defendant, get phony documents, or rush through the 80,000 driving tests, or... Apparently believing the judge would discount all the circumstantial evidence against Robleto, hence, invoking the OJ-esque defense which goes thusly, "if you don't have videotape of him committing the murders you must acquit." A bit overwrought, but the point is made.

The woman who has been convicted of providing Mr. Robleto with phony ID's (including the phonied envelopes --see previous posts for deets), reportedly has served her time and soon will be deported to her native land in which she has citizenship. Three guesses. Give up? Mexico. BTW: she got nuttin from the DA or state for her testimony in the trial we're told. No quid. No pro. No quo. Ole!

The judge has taken the case under advisement or something and is expected to render a verdict next Tuesday, November 7th, at 8:30 am. We'll be there.
